1. Acceptance of Terms
These Terms of Use & Subscription Terms ("Terms") are an agreement between you and Driver Support Club ("Driver Support Club," "we," "us," or "our") that governs your use of the DriveMV mobile app, this website, and related DriveMV services (together, "DriveMV").
By downloading, accessing, or using DriveMV, or by purchasing a membership, you agree to these Terms and to the DriveMV Privacy Policy. If you do not agree, do not use DriveMV.
2. Description of DriveMV
DriveMV is a consumer app and service from Driver Support Club that helps drivers understand and navigate DMV and RMV-related processes. Depending on your membership and the features available to you, DriveMV may include educational guides, explanations of common requirements, checklists, document organization tools, reminders, and access to additional support.
DriveMV is an educational and administrative support tool. It helps you understand and prepare. It does not make decisions about your license, registration, or case, and it cannot guarantee any outcome.
3. Eligibility
You must be at least 18 years old, or the age of majority where you live, to create an account or purchase a membership. If you are under 18, you may use DriveMV only with the involvement and consent of a parent or guardian, who is responsible for your use. DriveMV is not intended for children under 13.
4. User Accounts
Some features require an account. You agree to give accurate information, keep it up to date, and keep your login credentials confidential. You are responsible for activity that happens under your account. Tell us promptly through the Support page if you believe your account has been used without your permission.
You may request deletion of your account at any time, as described in the Privacy Policy.
5. Membership
DriveMV offers a paid membership, currently DriveMV Membership at $29 per month. Membership can include access to app resources, tools, guides, checklists, and member features. The specific features included may change over time as we improve DriveMV; if we remove a core feature, we will give you notice.
The price, billing period, and any applicable taxes are shown to you before you purchase. Prices shown in the App Store at the time of purchase, in your local currency, control.
6. Apple In-App Subscriptions
If you purchase a membership in the DriveMV iOS app, the purchase is an auto-renewable subscription sold through the Apple App Store. For these subscriptions:
- Subscription charges are processed by Apple. Payment is charged to your Apple ID account when you confirm the purchase.
- Subscriptions renew automatically unless cancelled through Apple at least 24 hours before the end of the current period.
- You manage your subscription through your Apple ID / App Store settings, including turning off auto-renewal and cancelling.
- Apple's applicable billing and refund rules apply, in addition to these Terms.
We do not control Apple's billing system, and we cannot directly charge, cancel, or refund App Store purchases. Your use of the App Store is also subject to Apple's own terms and policies.
These Terms are between you and Driver Support Club, not Apple. Apple is not responsible for DriveMV or its content, and has no obligation to provide maintenance or support for the app. To the extent permitted by law, Apple has no warranty obligation for DriveMV; if the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app, if any. Apple is not responsible for addressing any claims relating to DriveMV, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection or privacy claims, or intellectual property infringement claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.
7. Automatic Renewal
Memberships are subscriptions that continue and renew automatically at the end of each billing period, at the then-current price, until you cancel. For App Store subscriptions, your Apple ID account is charged for renewal within 24 hours before the end of the current period. If we change the price of a subscription, you will be notified in advance as required by Apple and applicable law, and you can cancel before the new price applies.
8. Billing
For App Store subscriptions, all billing is handled by Apple using the payment method on your Apple ID. Your Apple receipt is your record of each charge. If a renewal payment cannot be collected, Apple may retry the charge, and your access to member features may be paused until payment succeeds or the subscription ends.
Some Driver Support Club services may be offered outside the app, for example on driversupportclub.com. Those purchases are billed separately, under the terms presented at the time of purchase, and are not managed by Apple.
9. Cancellation
You can cancel an App Store subscription at any time in your Apple ID subscription settings: on iPhone, open Settings, tap your name, tap Subscriptions, choose DriveMV, and tap Cancel Subscription. See Apple's guide to cancelling a subscription for other devices.
When you cancel, you keep member access until the end of the period you have already paid for, and you will not be charged again. Deleting the app or your DriveMV account does not cancel an App Store subscription.
10. Restore Purchases
If you reinstall DriveMV, change devices, or your membership does not appear, you can use Restore Purchases in the DriveMV app while signed in to the same Apple ID used for the original purchase. Restoring does not create a new charge. See Restore Purchases on the Support page.
11. Refunds
Refunds for App Store purchases are handled by Apple under Apple's refund policies. You can request a refund from Apple at reportaproblem.apple.com. We cannot issue refunds for purchases made through the App Store.
Refunds for services purchased directly from Driver Support Club, outside the App Store, are governed by the terms presented at the time of that purchase. Nothing in these Terms limits any refund rights you have under applicable law.
12. Optional Human Support Services
Driver Support Club may offer optional human-support services, such as more hands-on help with an active DMV or RMV matter, to eligible members. These services are offered separately from the App Store subscription, may have their own price and eligibility requirements, and are described to you before you agree to them.
Human-support services are administrative and educational. They may include explaining requirements, helping you organize documents, and helping you prepare. They do not include legal advice or legal representation, and Driver Support Club staff do not appear on your behalf as your attorney or representative before any agency or court.
13. Acceptable Use
You agree not to:
- use DriveMV for any unlawful purpose, or to prepare false, misleading, or fraudulent documents or statements for any agency;
- upload content you do not have the right to share, or that contains malware;
- access another person's account or information without permission;
- interfere with, disrupt, reverse engineer, or attempt to gain unauthorized access to DriveMV or its systems, except where the law allows;
- scrape, copy, or resell DriveMV content or features; or
- harass or abuse our staff or other users.
14. Educational and Administrative Nature of Service
DriveMV provides general information and administrative tools to help you understand and prepare for DMV and RMV processes. Information in DriveMV is not tailored legal, financial, or professional advice. Rules, forms, fees, and procedures differ by state and change over time, and your situation may have details that general information does not address.
You are responsible for your own decisions, for meeting all deadlines, and for confirming requirements with the agency that handles your matter.
15. No Government Affiliation
DriveMV is an independent service operated by Driver Support Club and is not affiliated with or endorsed by any DMV, RMV, government agency, court, or law enforcement agency.
DriveMV is not an official government app or service. We cannot issue, reinstate, or change a license or registration, access official records on your behalf, or speak for any agency. Official decisions, notices, and records come only from the agency involved.
16. No Legal Representation
Driver Support Club is not a law firm, and neither DriveMV nor Driver Support Club staff provide legal advice or legal representation. Using DriveMV does not create an attorney-client relationship. If you need legal advice about your situation, including whether to appeal a decision or how to respond to a court matter, consult a licensed attorney in your state.
17. Accuracy of Information
We work to keep DriveMV content accurate and current, but government requirements can change without notice and we cannot guarantee that all content is complete, current, or error-free at all times. If something in DriveMV conflicts with a notice or instruction from an agency, follow the agency's instruction and let us know through the Support page so we can review it.
18. Third-Party and Government Resources
DriveMV may link to or reference third-party websites and government resources, such as official agency websites and forms. We do not control those resources and are not responsible for their content, availability, accuracy, or practices. Your use of them is governed by their own terms and policies.
19. Intellectual Property
DriveMV, including its software, design, text, guides, checklists, graphics, and the DriveMV and Driver Support Club names and logos, is owned by Driver Support Club or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use DriveMV for your own non-commercial purposes. For the iOS app, this license is also limited to use on Apple-branded products you own or control, as permitted by the App Store's usage rules.
You keep ownership of content you add to DriveMV. You give us permission to store and process that content only as needed to provide DriveMV and support to you.
20. Account Suspension or Termination
We may suspend or terminate your access to DriveMV if you materially violate these Terms, misuse the service, or if we are required to do so by law. Where reasonable, we will give you notice and an opportunity to fix the issue. You may stop using DriveMV and request deletion of your account at any time.
If we terminate your access for reasons other than your breach of these Terms, we will make reasonable efforts to help you request a refund of any prepaid, unused subscription period, subject to Apple's policies for App Store purchases. Sections that by their nature should survive termination will survive.
21. Disclaimers
To the fullest extent permitted by law, DriveMV is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that DriveMV will be uninterrupted or error-free, or that using it will produce any particular result with any agency or court. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
22. Limitation of Liability
To the fullest extent permitted by law, Driver Support Club and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or opportunity, or any consequence of a decision made by a government agency or court, arising out of or relating to your use of DriveMV.
To the fullest extent permitted by law, our total liability for any claim relating to DriveMV is limited to the amount you paid for DriveMV in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
23. Changes to Services or Terms
We may change, add, or remove features of DriveMV, and we may update these Terms from time to time. When we update the Terms, we will change the effective date at the top of this page. If a change is material, we will give reasonable advance notice in the app, by email, or by another reasonable method. If you continue to use DriveMV after the changes take effect, you accept the updated Terms. If you do not agree, stop using DriveMV and cancel any subscription.
24. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules, except where the law of your state of residence requires otherwise. Any dispute relating to these Terms or DriveMV will be brought in the state or federal courts located in Massachusetts, and you and we consent to their jurisdiction, unless applicable law entitles you to bring a claim in your home jurisdiction. Nothing in this section prevents either party from bringing an eligible claim in small claims court.
25. Contact Information
